Look the RPM database has the original MD5SUM and the time
datestamp.  Use rpm -v, if the file hasn't changed in any way since
the last time, then update it to the new RPM.  If it has changed,
then do nothing.  Still in install the file as an .rpmsave or
.rpmorig or whatever it is they do.  I'm not sure how exactly to
pull that off, but it should be possible to do (my RPM-foo is pretty
low).

	Thus people who blindly pull updates will migrate to a different
set of mirrors.  The people who actively maintain their up2date/yum
config files probably have, or will address this as soon as
possible.

	It's not unheard of for RPM's to move config files if you
upgrading to an incompatible config file system.  I know I've seen
it done a handful of times.
