The kernels supplied with WBEL are built with a simple "rpmbuild --rebuild
--sign --target <target>" except for the i586 package which won't build
out of the stock srpm but it only gets a one line tweak and then "rpmbuild
-bb --sign --target i586"

No they can't; the GPL is quite explicit on this subject.  And to the
best of my knowledge they are in full compliance.  Their kernel might be
patched out the wazoo, it might be a total Frankenstein horror, but it is
fully GPL compliant.  Plus the nature of RPM packaging makes it pretty 
hard to sneak in a hidden tweak.

The taroon list has also had a few threads about mysterious performance
problems related to swap so it is something that is probably being worked
on over at RH.
